SC quashes High Court verdict directing 3% sports quota in medical, dental colleges for Punjab
The Supreme Court overturned a portion of a Punjab and Haryana High Court order that the Punjab government grant three percent, rather than one percent, reservation at state-run medical and dentistry institutes under the sports category, stating that courts cannot issue writs to impose quotas.
The verdict came as a result of the Punjab government’s appeal against the Punjab and Haryana High Court’s 2019 common judgement, which asked for the issuance of a new notification to provide a raised sports quota of 3% in place of the executive-determined sports quota for the state’s government-run medical and dental colleges.
The High Court had previously ordered that “children/grandchildren of terrorist-affected individuals/Sikh riots affected persons in all private unaided non-minority Medical/Dental institutions in the state” be given a 1% quota.
In addition, the High Court ordered that the terrorist and riot-affected candidates be given preference for managerial positions.
