Yes it is applicable to all employees categorised as workers.The definition of “workers” under the new rules is similar to the definition provided under the Factories Act. However, this does not mean the benefits are only applicable to blue-collar workers, who work in factories.
Every individual contributor (person not engaged mainly in managerial/administrative or supervisory role- for supervisor the limit of Rs 18,000 of wages per month has been prescribed), irrespective of the work assigned to him/her or remuneration drawn (except in case of supervisor) should qualify as a worker under the new labour codes,
Yes, labour laws are well applicable to government employees infact it is the public sector that takes labour laws most seriously and because of this fact government jobs become so lucrative. It is the private sector that skips the labour laws and works on profit motive, forcing the employees to live a subsistence life.
Further it is important to know about functioning of labour market, an employer is always better placed than the employee. In today’s capitalist market the bargaining power is dwindling . A poor women would love to do knitting work just to avail two times meal.
Pawan567 Very well said Mr. Pawan. If we look into the history, the concept of Socialism came into existence only because of extremism that grew along with industrialisation in Europe, the capitalist mindset and brutal laws which were penned down for employees.
But as we have witnessed the disintegration or collapse of USSR in late 20th century, the reasoning that emerged as a result was extreme socialism for such highly populous integrated economy. On the other hand, China the neighboring country has emerged rapidly almost since 7th decade of 20th Century and yet created a huge economy in itself along with a big amount foreign reserve which can be used time to time to counter USA.
